Terms of Use

Welcome to Zoova. These Terms of Use ("Terms") govern your access to and use of the Zoova mobile application ("App") provided by Zoova ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree, do not use the App.

2. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You may not create multiple accounts for the purpose of abusing game mechanics.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Game Rules & Fair Play

Zoova is designed to be played fairly. The following activities are prohibited:

• Cheating: Using modified clients, bots, scripts, or any automated tools to gain an unfair advantage.
• Photo Fraud: Submitting pre-existing photos, screenshots of animals, or images from the internet instead of real camera captures.
• GPS Spoofing: Faking your location to catch animals or appear on the map in locations you are not physically present.
• Account Trading: Selling, buying, or transferring accounts or in-game items for real money outside the App.
• Exploitation: Exploiting bugs, glitches, or vulnerabilities in the App instead of reporting them.
• Harassment: Harassing, threatening, or bullying other players through any in-game communication.

We employ anti-cheat measures including device motion verification, photo hash deduplication, rate limiting, and GPS validation. Violations may result in temporary or permanent account suspension without refund.

4. In-App Purchases & Subscriptions

4.1 Premium Subscription

Zoova offers an optional premium subscription ("Zoova Premium") that provides additional features including unlimited daily catches, 2x XP rewards, expanded deck size, and exclusive content.

4.2 Payment

• All purchases are processed through Apple App Store or Google Play Store.
• Prices are displayed in your local currency and may vary by region.
• Payment is charged to your App Store or Google Play account at confirmation of purchase.

4.3 Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription through your device's App Store or Google Play settings.

4.4 Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

5. Intellectual Property

• The App, including all content, features, card designs, artwork, and game mechanics, is owned by Zoova and protected by intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
• You may not copy, modify, distribute, sell, or create derivative works based on any part of the App without our written consent.
• User-generated content (photos used for catches) remains your property, but you grant us a license to process it for game functionality.

6. User Conduct

When using Zoova, you agree to:

• Comply with all applicable laws and regulations in your jurisdiction.
• Not use the App while driving, operating machinery, or in situations where distraction could be dangerous.
• Respect private property and trespassing laws when searching for animals.
• Not interfere with or disrupt the App's servers, networks, or infrastructure.
• Not reverse-engineer, decompile, or disassemble any part of the App.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Disclaimers

• The App is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not guarantee uninterrupted or error-free service.
• Virtual items (cards, XP, in-game currency) have no real-world monetary value.
• We are not responsible for interactions between players outside the App.
• Animal detection accuracy may vary based on lighting conditions, camera quality, and other factors.

9. Limitation of Liability

To the fullest extent permitted by law, Zoova shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury arising from your use of the App.

10. Account Termination

• You may delete your account at any time through the App (Profile → Delete My Account).
• We may suspend or terminate your account for violations of these Terms.
• Upon termination, your right to use the App ceases, and your data will be deleted in accordance with our Privacy Policy.
• Active subscriptions should be cancelled through your device's store settings before deleting your account.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.

Kullanım Koşulları

Zoova'ya hoş geldiniz. Bu Kullanım Koşulları ("Koşullar"), Zoova ("biz", "bize" veya "bizim") tarafından sağlanan Zoova mobil uygulamasına ("Uygulama") erişiminizi ve kullanımınızı düzenler. Uygulamayı indirerek, yükleyerek veya kullanarak bu Koşullara bağlı olmayı kabul edersiniz.

1. Koşulların Kabulü

Bir hesap oluşturarak veya Uygulamayı kullanarak, en az 13 yaşında olduğunuzu onaylar ve bu Koşullara uymayı kabul edersiniz. Kabul etmiyorsanız Uygulamayı kullanmayın.

2. Hesap Kaydı

• Hesabınızı oluştururken doğru ve eksiksiz bilgi sağlamalısınız.
• Giriş bilgilerinizin gizliliğini korumak sizin sorumluluğunuzdadır.
• Hesabınız altında gerçekleşen tüm faaliyetlerden siz sorumlusunuz.
• Oyun mekaniklerini kötüye kullanmak amacıyla birden fazla hesap oluşturamazsınız.
• Bu Koşulları ihlal eden hesapları askıya alma veya sonlandırma hakkımızı saklı tutarız.

3. Oyun Kuralları ve Adil Oyun

Zoova adil oynanması için tasarlanmıştır. Aşağıdaki faaliyetler yasaktır:

• Hile: Haksız avantaj elde etmek için değiştirilmiş istemciler, botlar, komut dosyaları veya otomatik araçlar kullanmak.
• Fotoğraf Sahteciliği: Gerçek kamera çekimleri yerine önceden var olan fotoğraflar, hayvan ekran görüntüleri veya internetten alınan görseller göndermek.
• GPS Sahteciliği: Hayvan yakalamak veya fiziksel olarak bulunmadığınız konumlarda haritada görünmek için konumunuzu taklit etmek.
• Hesap Ticareti: Uygulama dışında gerçek para karşılığında hesap veya oyun içi eşya satmak, satın almak veya transfer etmek.
• İstismar: Uygulamadaki hataları, aksaklıkları veya güvenlik açıklarını bildirmek yerine kötüye kullanmak.
• Taciz: Oyun içi iletişim yoluyla diğer oyuncuları taciz etmek, tehdit etmek veya zorbalık yapmak.

Cihaz hareket doğrulaması, fotoğraf hash tekilleştirmesi, hız sınırlandırma ve GPS doğrulaması dahil hile önleme tedbirleri uyguluyoruz. İhlaller, iade yapılmaksızın geçici veya kalıcı hesap askıya almayla sonuçlanabilir.

4. Uygulama İçi Satın Almalar ve Abonelikler

4.1 Premium Abonelik

Zoova, sınırsız günlük yakalama, 2x XP ödülü, genişletilmiş deste boyutu ve özel içerik dahil ek özellikler sağlayan isteğe bağlı bir premium abonelik ("Zoova Premium") sunar.

4.2 Ödeme

• Tüm satın almalar Apple App Store veya Google Play Store üzerinden işlenir.
• Fiyatlar yerel para biriminizde gösterilir ve bölgeye göre değişebilir.
• Ödeme, satın alma onayı sırasında App Store veya Google Play hesabınıza yansıtılır.

4.3 Otomatik Yenileme

• Abonelikler, mevcut fatura döneminin bitiminden en az 24 saat önce iptal edilmediği sürece otomatik olarak yenilenir.
• Hesabınız, mevcut dönemin bitiminden 24 saat önce yenileme için ücretlendirilir.
• Aboneliğinizi cihazınızın App Store veya Google Play ayarlarından yönetebilir ve iptal edebilirsiniz.

4.4 İade

İade talepleri Apple veya Google tarafından kendi iade politikalarına göre işlenir. İadeleri doğrudan işlemiyoruz.

5. Fikri Mülkiyet

• Tüm içerik, özellikler, kart tasarımları, sanat eserleri ve oyun mekanikleri dahil Uygulama, Zoova'ya aittir ve fikri mülkiyet yasalarıyla korunmaktadır.
• Uygulamayı kişisel, ticari olmayan amaçlarla kullanmanız için sınırlı, münhasır olmayan, devredilemez bir lisans verilmektedir.
• Yazılı iznimiz olmadan Uygulamanın herhangi bir bölümünü kopyalayamaz, değiştiremez, dağıtamaz, satamaz veya türev eserler oluşturamazsınız.
• Kullanıcı tarafından oluşturulan içerik (yakalamalar için kullanılan fotoğraflar) sizin mülkiyetinizde kalır, ancak oyun işlevselliği için işlememize lisans verirsiniz.

6. Kullanıcı Davranışı

Zoova'yı kullanırken aşağıdakileri kabul edersiniz:

• Yargı alanınızdaki tüm geçerli yasa ve düzenlemelere uymak.
• Araç kullanırken, makine işletirken veya dikkatin dağılmasının tehlikeli olabileceği durumlarda Uygulamayı kullanmamak.
• Hayvan ararken özel mülkiyet ve izinsiz giriş yasalarına saygı göstermek.
• Uygulamanın sunucularına, ağlarına veya altyapısına müdahale etmemek veya bunları bozmamak.
• Uygulamanın herhangi bir bölümünü tersine mühendislik yapmamak, derlemesini çözmemek veya parçalarına ayırmamak.

7. Gizlilik

Uygulamayı kullanımınız, kişisel bilgilerinizi nasıl topladığımızı, kullandığımızı ve koruduğumuzu açıklayan Gizlilik Politikamız tarafından da yönetilmektedir.

8. Sorumluluk Reddi

• Uygulama, açık veya zımni hiçbir garanti olmaksızın "olduğu gibi" ve "mevcut olduğu şekliyle" sağlanmaktadır.
• Kesintisiz veya hatasız hizmet garanti etmiyoruz.
• Sanal öğelerin (kartlar, XP, oyun içi para birimi) gerçek dünya parasal değeri yoktur.
• Uygulama dışındaki oyuncu etkileşimlerinden sorumlu değiliz.
• Hayvan tespiti doğruluğu aydınlatma koşullarına, kamera kalitesine ve diğer faktörlere bağlı olarak değişebilir.

9. Sorumluluk Sınırlaması

Yasaların izin verdiği azami ölçüde, Zoova, Uygulamayı kullanımınızdan kaynaklanan veri kaybı, kar kaybı veya kişisel yaralanma dahil ancak bunlarla sınırlı olmamak üzere dolaylı, arızi, özel, sonuçsal veya cezai zararlardan sorumlu olmayacaktır.

10. Hesap Sonlandırma

• Hesabınızı istediğiniz zaman Uygulama üzerinden silebilirsiniz (Profil → Hesabımı Sil).
• Bu Koşulların ihlali durumunda hesabınızı askıya alabilir veya sonlandırabiliriz.
• Sonlandırma üzerine Uygulamayı kullanma hakkınız sona erer ve verileriniz Gizlilik Politikamıza uygun olarak silinir.
• Hesabınızı silmeden önce aktif aboneliklerin cihazınızın mağaza ayarlarından iptal edilmesi gerekmektedir.

11. Bu Koşullardaki Değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. Önemli değişiklikleri Uygulama aracılığıyla veya "Son güncelleme" tarihini güncelleyerek size bildireceğiz. Değişikliklerden sonra Uygulamayı kullanmaya devam etmeniz, güncellenmiş Koşulları kabul ettiğiniz anlamına gelir.

12. Geçerli Hukuk

Bu Koşullar, kanunlar ihtilafı ilkelerine bakılmaksızın Türkiye Cumhuriyeti yasalarına göre yönetilecek ve yorumlanacaktır.
